Sole Application for Divorce

Suitable if your Ex will not cooperate or you wish to apply for divorce by yourself.

Sole Application

Fixed Fee - $700 (+GST)

It may not always be possible or even appropriate to make a Joint Application.

We can assist you in making a Sole Application, which means you can apply for a Divorce, even if your Ex doesn’t want to apply or be a part of the process.

You will need to ‘serve’ a copy of the filed Divorce paperwork to your Ex. If you’d like us to assist you in organising the ‘serving’, we have an affordable fixed price of $150 (+GST) for this service.

In some cases, you may need to attend a Court hearing. We can arrange for this to be attended to via phone.

Drafting documentation
Arranging signature and swearing by you and your Ex
Filing on the Court portal
Arranging The Divorce hearing
Obtaining the Divorce Certificate and sending it to you
Zoom meetings, if and when required, to finalise documentation

Fixed Fee does not include any third party costs that are associated with your divorce:

Court filing fee (currently $1,060 or $350 concession)
‘Serving’ fee
Additional Affidavits
Court attendance

What can you expect from Modern Divorce Solutions?

Once the client acceptance form is completed, you only need to pay 50% of the fixed fee to start. The second instalment can be made once the Divorce Application has been filed with the Court.
No more boring PDF questionnaires to fill out. We’ve designed a more intuitive experience that will help you answer which questions are relevant to your situation.
The Questionnaire will be emailed to you once you’ve completed the Client Acceptance Form.
We receive your answers and scanned copies of your Marriage Certificate and, if applicable, passport/visa. If there is any information missing, don’t worry, we’ll get in touch.
There is no need to leave the comfort of your own home. We can finalise your documents via Zoom - where you ‘swear’ and send us your scanned Affidavit.
We also have appointments available outside of business hours. Just let us know what times are best for you.
With a ‘Sole Application’, we can arrange for the Divorce papers to be ‘served’ to your Ex and arrange for service documents to be signed and also filed with the Court.
If necessary, we can also arrange your attendance by phone.
It takes approximately 1 month and 1 day after the Divorce hearing for your Divorce to be finalised.
We will retrieve the Divorce Certificate and forward it to you.
